Arbitrators
Arbitration is form of ADR, whereby a dispute is submitted, by agreement of the parties, to one or more arbitrators who make a binding decision on the dispute. In choosing arbitration, the parties opt for a private dispute resolution procedure instead of going to court. Arbitration is a proceeding in which a dispute is resolved by an impartial adjudicator whose decision the parties to the dispute have agreed, or legislation has decreed, will be final and binding. There are limited rights of review and appeal of arbitration awards.
Mediators
Mediation is an effective way of resolving disputes without the need to go to court. It is another of the methods of alternative dispute resolution (ADR) available to parties. Mediation is essentially a negotiation facilitated by a neutral third party. It involves an independent third party – a mediator – who helps both sides come to an agreement. The Mediator uses specialised communication skills and negotiation techniques to facilitate disputing parties bridge their differences and find their own mutually acceptable solution to the dispute.
Concilliators
Conciliation is an alternative out-of-court dispute resolution instrument. Conciliation is an alternative out-of-court dispute resolution instrument. As a non binding procedure, Conciliation operates through an impartial third party, known as the conciliator, who assists the parties to a dispute in reaching a mutually agreed settlement of the dispute. Three major advantages of conciliation process are speedy settlement, economic viability and amicable resolution.
